2. Definitions
In these terms and conditions, the following definitions apply:
- Entrepreneur: Stokerij Sculte B.V.
- Customer: the consumer or business customer who enters into an agreement with the Entrepreneur.
- Consumer: a natural person who is not acting in the exercise of a profession or business.
- Agreement: the distance purchase agreement between the Entrepreneur and the Customer.
- Product(s): all items offered via the webshop.
3. Applicability
- These general terms and conditions apply to every offer and every (distance) agreement between the Entrepreneur and the Customer.
- Deviations are only valid if confirmed in writing or electronically by the Entrepreneur.
- Any (purchase) conditions of the Customer are expressly rejected, unless otherwise agreed in writing.
4. Offer and Formation of the Agreement
- The offer in the webshop is non-binding and subject to availability.
- Obvious mistakes or apparent errors in the offer do not bind the Entrepreneur.
- The agreement is concluded at the moment the Customer completes the order and receives an order confirmation (by email or in the checkout).
5. Age Limit and Alcohol
- The sale of alcoholic products is only permitted to persons aged 18 and over.
- By ordering, the Customer declares to be 18+.
- Upon delivery, the carrier may request identification and/or a signature upon receipt may be required. If delivery is not possible due to age verification or the absence of a recipient, additional costs (such as a new delivery attempt) may be charged to the Customer.
6. Prices, Shipping Costs and Payment
- All prices in the webshop are in euros and include VAT, unless otherwise stated.
- Shipping costs are calculated at checkout and are:

- Orders up to €80: €7.25
- Orders from €80: free shipping
- Payment is made via the payment methods offered at checkout.
- The order will only be dispatched after receipt of payment, unless otherwise agreed.
7. Delivery and Execution
- The Entrepreneur usually dispatches orders within 3 working days.
- Delivery takes place at the address provided by the Customer. The Customer is responsible for correctly entering address details.
- The Entrepreneur is not liable for delays by the carrier but will endeavor to resolve problems where possible.
- The risk of damage or loss passes to the Customer at the moment of delivery to the Customer (or a recipient designated by the Customer).
8. Right of Withdrawal (Consumer)
(This article only applies to consumers.)
- The Consumer has the right to withdraw from the agreement within 14 days of receipt of the order without giving reasons.
- During the withdrawal period, the Consumer must handle the product and its packaging with care.
- To exercise the right of withdrawal, the Consumer must first contact the Entrepreneur via info@stokerijsculte.nl (or via the contact page) and state at least the order number.
- After withdrawal, the product must be returned as soon as possible, but no later than 14 days after the withdrawal notification, unless otherwise agreed.
- Condition: returns are generally only accepted if products are unopened, unused, and in their original (undamaged) packaging.
- If the Customer has used a product more than necessary to assess it, the Entrepreneur may charge a depreciation.
Exclusion/Limitation of Right of Withdrawal
- Products that are no longer in their original state, have been opened (e.g., bottle opened), or can no longer be sold as new, may be (partially) excluded from reimbursement, unless there is a defect or error on the part of the Entrepreneur.
9. Returns, Damage, and Incorrect Delivery
- Returns are processed by contacting the Entrepreneur. Together, we will assess what is possible (e.g., return, exchange, or an appropriate solution).
- Is the order damaged or incorrectly delivered? Please contact us as soon as possible and send (if possible) photos of:
- the outside of the box
- the product / the damage
- the shipping label
- Returns that arrive damaged due to insufficient packaging may be (partially) refused or lead to depreciation.
10. Refund
- After a correct withdrawal and receipt (and inspection) of the return shipment, the Entrepreneur will refund the purchase amount as soon as possible, but no later than 14 days after the withdrawal notification.
- The Entrepreneur may withhold the refund until the return shipment has been received or until the Customer demonstrates that the return shipment has been sent.
- Refunds will be made using the same payment method as used for the original purchase, unless otherwise agreed.
- Any shipping costs for returns are for the account of the Customer, unless otherwise agreed or unless there is an error/defect on the part of the Entrepreneur.
11. Conformity and Warranty
- The Entrepreneur guarantees that the delivered products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness.
- If a product does not comply with the agreement, the Customer must report this within a reasonable time after discovery.
- Any additional warranty (e.g., from a manufacturer) does not affect the Consumer's legal rights.
12. Liability
- The Entrepreneur is not liable for indirect damage, consequential damage, lost profits, missed savings, or damage due to business interruption.
- The Entrepreneur's liability is in all cases limited to the amount of the order to which the liability relates, or (if lower) the amount paid out by the insurer.
- The Entrepreneur is not liable for damage resulting from incorrect or incomplete use of the product or from failure to follow (storage/use) instructions.
13. Force Majeure
- Force majeure means: circumstances beyond the will and influence of the Entrepreneur, as a result of which performance cannot reasonably be required (such as malfunctions, transport problems, illness, government measures, fire, strikes).
- During force majeure, obligations are suspended. If the force majeure lasts longer than 30 days, both parties may dissolve the agreement without liability for damages.
14. Intellectual Property
All intellectual property rights relating to the webshop, texts, photos, logos, and other content belong to the Entrepreneur or its licensors. Nothing may be copied or used without prior permission.
15. Complaints
- Complaints can be submitted via info@stokerijsculte.nl.
- The Entrepreneur aims to respond substantively within 5 working days.
- If you cannot resolve it with us, the Consumer (if applicable) can also use the European ODR platform (online dispute resolution).
16. Applicable Law and Disputes
- All agreements are governed by Dutch law.
- Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law dictates otherwise.
17. Amendment of the Terms and Conditions
The Entrepreneur may amend these general terms and conditions. The most recent version is available on the website. For current agreements, the version applicable at the time of the order remains in force, unless the law stipulates otherwise.
